I am arguing at a societal balance stand pint where one must balance the rights the populace has with the rights to profit corporate has, IMO one must not allow absolute power over information/media to corporate its just setting us up for the fall thus why I argue free distribution should be made free and treat illicit profit like drug distribution.

With that said there is nothing you can do but capitulate with C&D if you are a reputable group or a group who whats to remain active in the "light of day" if you will.

All you guys can do is maintain a balance based on if they whine you take it down it will slow the coming day when they make all forms of infringement a criminal offense... if just by days....

I hope they realize the folly of that mindset, antiquated distributionary schemes that have not evolved since the time of wax cylinders and pen and papper will only place fascist restrictive rules on society.

Rant mode is over 9000!
Sorry if I am whiny and confusing...I can do something abotu the whineyness when I try... LOL

Keep up the great work!

What we _can_ do and what we _should_ do are two different things. Frankly, the licensors haven't been suing fansubbers like the riaa/mpaa, because it breeds bad blood in the community.

Fansubbers as a community generally follow the rule "drop on c&d", for exactly the same reason: doing so keeps the licensors from being forced to resort to tedious and expensive lawsuits.

There's not a lot of honest defenses for fansubbing that would hold up in court, and trying to avoid the issue by applying pressure over the last episode of hellsing ultimate or the last half a dozen episodes of nabari no ou might sound good if you're a huge fan of those series, but it's really really bad for fansubbing as a whole. And if you're that much of a fan, maybe you should consider dropping some coin on it and supporting the series production. And if you're _here_ and not happy about it, you definitely shouldn't hide behind the "it takes too long for the releases to happen" line, because ... frankly, aone's not exactly a speedsubber these days.

Moreover, if we "lawyer up" and fight over something as clearcut as this, it might work, the licensor might back off, because both we and they have leeway to do so. They're not at the very last end of their rope financially yet, and we're not actually being sued yet. But eventually their end of that rope is going to be a little too close for comfort, and they'll actually file a lawsuit. And when that happens, it'll be bad blood, the company will have its popular opinion crucified in the eyes of the people who don't actually buy their products anyway, a court will hear the case and find against the fansubbers and against fansubbing as a whole and probably impose hefty fines on the nebulous and irresponsible entity that is the group and/or the distribution site, which will spend years in appeal before a tiny fraction of the original damages finally get paid. And all of that will have the effect of setting a clear legal precedent, and any fansubber who even remotely cares about their own continued personal comfort will put down the text editor, hang up their timing software and find a new hobby.

So... the question is: which is more harmful to (a) our reputation as a distribution site, (b) the group's reputation as a community-conscious fansub group, and (c) fansubbing as a whole. And the answer to all three is pretty damned clear, from where I sit: the site, the group and the community as a whole are better served if we all honor the community convention of quitting on C&D. Sorry if that interfered with your plans or short-range desires.

Tiberias

The problem is the process is one sided and making it difficult to to fight or question unless you have money to make them fear you can sue them.

I had 3 accounts on youtube taken down for showing anime clips of stuff not licensed in the states.

thf
if so it will get subed that's all that matters there are more and more qaulity anonymous releases by the year (slayers evolution-r,ect) they can't stop free distribution no matter what they do.
They should focus on the crappy china sub dvds and other illicit profit based crap and leave non profit based "shearing" alone.

You guys know that you can require proof of ownership before taking content/torrents down, right?
I've heard of people replying with that before, and never getting any responses. This might be helpful, if you're the type to fight for your 'rights.'

As of about a year ago, gotwoot is no longer part of the EAD tracker network, because EAD torrent mirroring got our server disconnected. The tracker was tracking mpaa-interested movies, riaa-interested music, and a bunch of random crap, and we got like 5 c&d orders in 3 weeks, and none of them were for our torrents but all of them were on our tracker. I run the tracker now, and a couple people in aone distro have access to manage torrents on it.

The Hellsing Ultimate OVAs will run more than 5 (mostly like 6 if they follow suit of many other OVAs). Shame you guys feel the need to drop it. Aone's Hellsing was easily the best subs out there. Oh well, can't blame people for not wanting to face potential law suits. Thankfully other groups are still active on Hellsing (at the moment anyway). Its just a shame they're not as good.

I don't think I quite get the situation. Were the torrents taken down by AonE staff themselves, or some third party contacted depthstrike or whoever else has power over the tracker and deleted them there?

If it's the latter, then...you know. There are other distro methods....
